Cuomo orders probe into immigration tenant bias - NY Daily News complaint letter to landlord

Gov. Cuomo has ordered a multiagency investigation into whether landlords across the state are discriminating against immigrants — including asking them to prove their citizenship or face eviction.

The Daily News reported exclusively on Sunday night that 23 apartments in a building on 42nd Ave. near Junction Blvd. in Corona, Queens had received such a letter.

“If you fail to comply, we may have to terminate your lease and may have to evict you from the apartment,” the notice read.

Cuomo directed the state Division on Human Rights and departments of State and Homes and Community Renewal to investigate the actions at the building, which is owned by Jaideep Reddy of Long Island. Cuomo said the probe would also seek to determine whether a broader problem exists statewide. And the state will create an education campaign for landlords and tenants.

NYC landlord demands tenants prove immig status or face eviction

“These allegations of fear and intimidation are unacceptable, illegal, and run counter to everything New York represents,” Cuomo said.

The existence of the letter became public after a constituent complained to state Sen. Jose Peralta (D-Queens) last week.

A furious Peralta filed a complaint Monday with the office of state Attorney General Eric Schneiderman.

“This is unreal — and sadly, it seems that it’s open season against immigrants since the election of Donald Trump,” Peralta said.

Schneiderman’s office sent Reddy a cease-and-desist missive Monday, which said his letter violates city and state law in several ways.

The attorney general’s office “will not tolerate threats of eviction and other forms of tenant harassment based on immigration status,” special counsel Jessica Attie wrote.

City officials said they learned of the letter on Friday and issued their own cease-and-desist letter.

Mayor de Blasio, appearing on NY1’s “Road to City Hall” Monday night, pointed to the clause that said Reddy could be fined up to $250,000.

“This is a very, very serious thing ... We are going to give this landlord one chance only to get it right,” the mayor said.

City Council Speaker Melissa Mark-Viverito called the letter “abhorrent.”

“We’re living in such incredible times, where people feel emboldened to flagrantly abuse vulnerable individuals,” she said.

Izzy Myers, 19, accused the landlord and super of “being racist” to tenants and neighbors.

“He’s trying to come up with a whole lot of reasons just to try and kick me out,” Myers said.

On Sunday, building owner Reddy blamed the building’s electrician Eddie Peralta, who promptly blamed his secretary and then invoked Trump.

“What Donald Trump is doing is right!” he screamed. “Look what we do for all these illegal aliens, and what do they do? They commit homicides. They go raping people.”

Reddy, a physician, said Monday he was upset at how he was being portrayed in the media.

“Whatever damage was done is done now. How am I supposed to explain this to all of my patients?” he asked.

City Human Rights Commission officials said discrimination complaints jumped 60% in 2016 — a trend that has continued into 2017.

Background

Address : Ground floor flat, 14 Folly Close, Bristol BS41 9VB

Details of any payments requested and any payments made.

Rent

The rent is £800 every month and I am up to date with payments.

4

Complaint/ repairs needed

Identify clearly what has gone wrong or needs fixing.

Give any relevant dates.

Be clear about any problems this is causing you.

Some examples are given:

Repairs needed

The repair work that is needed is as follows:

The radiators in the sitting room are not heating up. It has been like that since we turned the heating on in October. The room is now so cold we can't use it.

The cold water pipe to the kitchen sink has started leaking. I only noticed it 2 days ago because it is leaking onto the carpet in the hall. This is now damp and is likely to stain and go mouldy if it is not fixed soon. I attach a photo of where it is leaking and the damage to the carpet.

The handrail on the stairs is loose and is not safe. I first noticed this yesterday. I am worried that one of my children might be injured going up the stairs. Because of the danger please arrange for a really quick repair. I have attached photos of the stairs and also of broken fixing of the handrail.

On Wednesday 10 November I noticed the front door lock was not working properly. When I came back you could just push the door open. It means that the house is not secure and is at risk of theft.

If the problem is not fixed the resultant damage may get worse and cost more to put right.

5

Problems caused

Give details of any problems, injuries or losses you have suffered as a result.

If relevant refer to photos.

Some example options are given.

Problems caused as a result:

So far there has been no injury or incident caused but I am concerned that this may change if the repairs are not made quickly.

I have to pay an extra £10 a week in using an electric heater. My own rug in the entrance hall has gone mouldy from the water leak and I have had to throw it out. I had bought it new for £120 only 2 months ago.

The damp is affecting the health of my family. My GP has told me it is making my daughters asthma much worse and she may be able to bring a claim for her extra suffering.

My elderly mother suffered a nasty fall last night and had to be treated at A&E. She needs the handrail to get up the stairs. She may bring her own claim for injury compensation and her expenses.

6

Losses and expenses

If the problems have caused you losses or expenses - give details.

Also provide proof of the damage and cost of repairs or replacement wherever possible.

Some examples are given:

Losses and expenses

Here is a photo of the electric heater I have had to start to use. I will be able to provide copy electricity bills to show I now have to pay an extra £10 every week for the last 3 weeks.

I attach the receipt for the rug I bought just 2 months ago for £120 as well as the photo of the mould before I throw it out.

I will be talking legal advice on the injury compensation claim and will provide further details in due course.

7

Remedy

Be as clear as possible about the remedy you would like.

Say what action you would like them to take (or stop).

Where you are asking for a payment - put a price on the you seek.

Remedy

Please contact me as soon as possible to arrange a time to inspect the problem and for the repair work to be carried out.

Either you or your repair person can contact me on 07701082334.

Please also confirm that you agree to pay me the losses and expenses set out above.

9

Consequences
